Overview: From the executive summary: ‘The United States Sentencing Commission strongly supports the efforts to punish more appropriately and prevent corporate crime and serious fraud offenses, as underscored by the amendment implementing the Sarbanes-Oxley Act. Because of the amendment, the Commission hopes that many serious fraud and related offenses will be deterred, and the individuals, companies, and other organizations that choose to commit serious crimes will appropriately receive severe punishment. The Commission will continue to monitor the effectiveness of the relevant guidelines and study whether further modifications are required in future.’ The paper discusses the increased penalties outlined under the Act.
