Overview: In a hostile environment, employees are subjected to an unwelcome and offensive work environment based on their protected status. This type of work environment interferes with their performance. In such cases, employers can be liable for compensatory and punitive damages. However, if an anti-harassment policy is adopted by the organization, such cases could be prevented. This would be the best defense against hostile environment harassment claims. The paper examines this issue.
