Overview: This article discusses two goals first it suggests a possible reason why parts of legal academia have reacted so favorably to the open source philosophy and second it takes a closer look at the philosophy itself and try to show that it is conceptually flawed. It explores how intellectual property law is currently applied to the two aspects of software. Putting this question at the beginning of the discussion is helpful because in many ways it holds the key to understanding and evaluating the complex issues surrounding the open source movement.
