Overview: One of the most challenging issues in antitrust enforcement is balancing the government’s need for information to investigate and prosecute the small number of mergers that raise competitive concerns against the time and cost burdens imposed on the parties complying with informational requests. This article focuses on procedural reforms instituted in April 2000 including: the establishment of independent reviewers to determine whether companies had complied with second requests; the requirements of a conference about the second request within five days after it is issued; and a five day deadline for staff to respond to requests for modification of the second request. The agencies have codified these procedures within their regulations.
