Overview: This article discusses the digital trade agenda of the U.S. In August of last year, U.S. Congress enacted the Bipartisan Trade Promotion Authority Act of 2002. Thereby it has ended an eight-year period in which the United States lacked the fast-track authority to conclude trade agreements with a simplified congressional ratification procedure. With respect to other elements, however, the U.S. multi-track initiative for digital trade remains a very promising undertaking that may also foreshadow how majorities can be found among an increasingly heterogeneous WTO membership and how “regulatory best practices” are promulgated via trade agreements.
