Overview: "Discovery of electronic data is not new. Since 1970, the definition of a “document” in Rule 34 of the Federal Rules of Civil Procedure has included a reference to electronic data. It has become evident that computers are central to modern life and consequently also to much civil litigation. This article challenges that assumption. In particular, this article briefly reviews the explosive growth of the “paperless” business environment, reviews the history of judicial concerns about “fishing expeditions,” and then applies these historic concerns of overbreadth and burden in light of the plethora of electronic information and argues for a flexible approach to electronic discovery issues.
