Overview: The sudden and dramatic reversal in the financial condition of many high-tech companies, and the ensuing softening of the local commercial real estate market, has led to a flood of sublease space on the commercial real estate market. The most basic pitfall involves the legal status of the subtenant of a sublet space. A subtenant’s rights pursuant to a sublease are entirely dependent upon the existence of the master lease for the space. This article describes these issues in greater detail, and attempts to provide practical solutions designed to allow all of the parties to a sublease to successfully complete the transaction.
