Overview: Employers complained that under a scenario like that allowed by the appeals court, they could be required to hire employees with serious illness or disability and could, in turn, be sued if the employees were injured or killed on the job. During oral argument, Justice Anthony M. Kennedy told lawyers for the worker, "We want employers to care about their employees. You want employers to take a position that’s completely barbarous."
