Overview: Employers who have struggled with the issue of how to handle employee requests for accommodation in the workplace under the Americans with Disabilities Act ("ADA"). The federal law passed by Congress in 1990 to protect disabled individuals from employment discrimination will find some welcome clarification of their obligations in three recent decisions from the United States Supreme Court. But these new Supreme Court decisions make clear that this duty applies only to those workers who are actually and substantially limited by their physical or mental conditions, significantly clarifying and narrowing the scope of this important federal law.
