Overview: Employers have a duty to provide their employees with a workplace that is safe and free from hazards. This includes the actions of other employees. Companies are liable for the actions of their employees. This means that a company can be held responsible even if the company did nothing wrong. The employer is responsible for the actions of an employee even when the employee is not acting in accordance with company policies. These laws are particularly important in the hiring process since employers can be and are held liable on the grounds of negligent hiring or negligent retention of an employee who has a known propensity for violence. More and more firms recognize the need to pre-screen their employees. Using these tools after the event is like locking the barn after the horse has been stolen. A better idea is to use them in the hiring process. This is the only way to keep psychopaths off the payroll.
