Overview: Ever since the adoption in the 1970s, compliance with the EU tendering directives has been problematic. Many studies have reported on the effectiveness of the directives, mostly in terms of impact on the openness of public procurement and the impact on cross-border trade. However, relatively little work has been undertaken on the compliance as such, while no empirical studies have been carried out to explain the (lack of) compliance with EU directives. This paper identifies a number of explanatory variables of which the impact on compliance has been quantified, using data from a survey among 147 responding purchasing professionals of the Dutch Ministry of Defence. The results of the paper indicate that the purchaser's familiarity with the rules and organisational incentives both have a positive impact on compliance.
