Overview: People are poor because they have no money. Countries are less developed because they have no capital. These truisms have a profound impact on the development assistance provided by rich countries to the poor countries, as evidenced by the tendency to measure development assistance by the amount of resources transferred from the rich to the poor and the emphasis on the creation of an environment friendly for foreign direct investment, with such investment widely viewed as an important addition to the capital starved economies of the less developed countries. This paper briefly considers the legal impediments to the mobilization of local resources.
