Overview: During the past several years there has been a great deal of confusion concerning compliance with New York state prevailing wage regulations, both as they apply to employee benefit plans and to their enforcement by the New York state Department of Labor. The Labor Department has issued a significant change in its enforcement policy of fringe benefit plans, and this change is having a destructive impact on non-union construction companies engaged in public works projects and on their employees.
