Overview: With recent growth in the hedge fund industry, securities industry regulators are increasing enforcement actions and focusing on establishing a regulatory framework for hedge funds on a par with frameworks for other financial services segments. Securities and Exchange Commission (SEC) staff recommended that hedge fund advisers be required to register as investment advisers under the Investment Advisers Act of 1940. With the likely adoption of this registration requirement, hedge funds and their advisers - whether or not they are currently registered as investment advisers - should increase their focus on assuring that they have a strong compliance culture and internal control environment in place.
