Overview: Growing windfalls and disproportionately large court and arbitrator awards on lost profit and similarly speculative claims have led to major losses by owners and contractors and increased litigation. These claims involve highly subjective, ripple-effect cost impact estimates growing out of project delays and disruptions. This paper points out that delays and their resulting costs generally involve complex circumstances where fault is shared by numerous parties. The end result has been uncertainty and a misallocation of risk to those lacking adequate control.
