Overview: The paper depicts that the Pensions Regulator has now started to issue guidance on those requirements of the Pensions Act 2004 which relate to the security of members' benefits. The Pensions Act introduced powers for the Regulator to require companies other than the sponsoring employer (or even individuals) to contribute to the pension scheme if they have been party to an action to avoid pension liabilities. The idea is to prevent corporate restructuring being used to leave a worthless shell company as the sponsoring employer.
