Questioning the Economic Justification for Copyright

Overview: This article questions the economic justification for copyright law's prohibition against unauthorized copying (17 U.S.C. º106). It identifies and explains how new technologies and social norms provide many viable business models for financing new creations without the need for the current broad copyright protection. More significantly, it contends that, in the current lottery-like media entertainment markets, the higher revenues generated for popular creations due to º106 are generally used for promotional efforts (rent seeking), which tends to crowd out borderline creations. This article recognizes that C3s are often expensive to create and promote and it addresses all types of popular culture, mainly music.
