Overview: The idea of dissenting jurisprudence relates not only to the development and application of alternative legal philosophies about law, justice, and the legal system. It also relates to applied jurisprudence in the form of non-mainstream criticism of judicial methodology generally and High Court adjudication in particular, as well as unconventional incorporation of jurisprudential theorizing within conventional legal education, research, and practice. Some guidelines are suggested in the paper for integrating theory and practice in scholarship and education about judicial decision-making and legal opinion-writing, for use as resources in teaching and learning.
