Overview: More than year has passed since the Terrorism Risk Insurance Act of 2002 TRIA became law, causing the US to join the list of nations with government-sponsored terrorism insurance plans. During that time, the US Department of the Treasury has issued a series of guidance documents and regulations interpreting and clarifying the new law. Nevertheless, this article focuses on several important issues regarding how TRIA operates, especially with respect to captive insurers and other self-insurance arrangements that are still to be resolved.
