Overview: Selling real estate can be complex and difficult. In Alberta, the sale of real estate - including the sale of real estate by auction - is governed by the Real Estate Act. The Real Estate Act allows the Real Estate Council of Alberta to set standards of competency that must be met by those who are licensed to sell real estate. The Real Estate Council offers protection to buyers and sellers through its audit and investigation program. The purpose of this article is to explain the legislative requirements relating to the sale of real estate by auction, and to discuss the relationship between auctioneers and real estate brokers.
