Overview: Two recent court decisions could result in greater legal exposure for US private equity investors forced to close struggling portfolio companies. federal district courts in New York and North Carolina have held that private equity funds that invested in, and had representatives on the boards of directors of, failed portfolio companies were "employers" for purposes of WARN. This article explains the implications of these court decisions for the industry.
